What we are watching
Public signals on regulated commerce in Europe. They inform the architecture Seldon builds. Each one is monitored, not guaranteed, and each one is sourced.
01Where Europe is
WhatsApp's business terms
Updated on 15 October 2025, in force from 15 January 2026. AI providers may not use WhatsApp where AI is the primary function, as the platform decides at its sole discretion; the carve-out for purpose-driven verticals stays. WhatsApp business data is not used to train or fine-tune AI models, a condition independent of geography.
Three classes of claim, not interchangeable
Legal pressure: the European Commission's Statement of Objections of 9 February 2026, covering the EEA except Italy; the AGCM's interim measures in Italy of 24 December 2025; the CADE's parallel track in Brazil; a €200M DMA fine on WhatsApp's owner of 22 April 2025; the EU General Court's split verdict of 3 June 2026; and the DSA designation of WhatsApp of 26 January 2026, for Channels only. Platform terms: the business terms above. Operating permission: jurisdiction-specific today.
The EU AI Act
The Article 50 transparency duties for conversational AI apply from 2 August 2026, with fines of up to €15M or 3% of global turnover. The Annex III high-risk duties apply from 2 December 2027, under the Digital Omnibus agreement of 7 May 2026. Under Article 2 the Act also reaches providers outside the EU who serve people in the EU.
The EU Tech Sovereignty Package and Spain's ENS
The package was adopted on 3 June 2026. Royal Decree 311/2022, the ENS, requires EU-resident data and storage in Spain or the EU as a condition for Spanish public-sector contracts (the text in the BOE).
Chat substrates
Tchap in France (built on Matrix; 600,000 registered users and over 500,000 monthly active users as of May 2026; DINUM a Silver member of the Matrix.org Foundation since 21 October 2025), BundesMessenger and BwMessenger in Germany (the latter with over 100,000 active users), and motions in Belgium, the Netherlands, Sweden, Greece, the European Commission and Luxembourg. “Replacement” applies only where public-sector use is evidenced.
Vertical AI in regulated commerce
Production-scale vertical AI products built on language models are emerging, backed by large funding rounds in 2026. The literature on what defends them agrees: workflow integration, proprietary execution traces and vertical expertise, not the underlying model. US-headquartered providers carry US-parent jurisdiction, whatever their EU data-centre footprint.
02Where Seldon is
We read these signals as inputs to architecture decisions. The thesis is dependency reduction, workflow portability and sovereignty options. A transport-agnostic core is the answer to a market where regulators contest the messaging channel. Matrix is the first sovereignty-aligned channel in validation.
These are observations, not claims of advantage. Each part of the thesis remains a monitored condition.
03What we build
A vertical core that does not depend on any single messaging channel, with a compliance lattice per vertical and an adapter per channel. Whatever happens to the regulatory window, the platform's terms or today's operating permission, the conversation engine does not need rebuilding.
04Disclosures
- Bridging Matrix and WhatsApp works, but the bridge server decrypts each message before re-encrypting it toward WhatsApp. Copy that claims sovereignty must separate Matrix-native conversations from bridged ones.
- The DSA designation of WhatsApp covers Channels only; it does not imply that private WhatsApp messages fall under it.
- The General Court's ruling of 3 June 2026 is a split verdict, neither a broad win nor a broad loss for the platform.
- Matrix governance and end-to-end validation items are still open.
